2022 Election Recounts


The CD3 Representative race triggered a required recount due to the close results. Secretary of State Jena Griswold Ordered the Recount on November 30, 2022.  The recount started on December 2, 2022 in Alamosa County where they performed the Logic and Accuracy Test and started Rescanning the ballots.   Colorado Statute § 1-10.5-102 (3)(a) states: Prior to any recount... The [Canvas] board shall use the voting devices it has selected to conduct a comparison of the machine count of the ballots counted on each such voting device for the candidate race to the corresponding manual count of the voter-verified paper records. The Secretary of State's Order for the recount directs the County Clerks to bypass this vital step in the recount.  What are YOU going to do about it?

JUSTICE v GRISWOLD 
How could you ask for a better case title?  Forever on the official record there will be a case titled Justice v Griswold.  God is Good. Mr. Justice filed a Petition and Emergency TRO on Friday December 9, 2022 in the 7th District Court of Colorado.  The judge denied the TRO for lack of proof of harm, however a conference hearing is set for Monday Dec 12 at 4pm. 
12/12/2022 UPDATE The judge denied the TRO and Motion for Injunction but the Petition pursuant to 1-1-113 CRS is still in the court.  The Respondents have 21 days to file a response, I expect a Motion to Dismiss saying this can only be filed in Denver.  Justice will then File a reply proving them wrong.

CARLETON et. all. v GRISWOLD
Four Electors have filed a Petition with the Colorado Supreme Court for an Emergency Order to Stop the recount and perform the required testing of the voting devices compared to the Voter-Verified Paper Record.

Send the Following letter to the county clerks in CD3.  Show up at the election center and peacefully watch the public recount.  Talk to the clerk and election supervisors. If you be an official watcher, be an official loiterer in the hall ways, educating everyone who will listen about the power of 102(3)(a). Ask them “Sir/Mam, I happened to notice the statutory requirements for testing the machines is not being followed, were you aware that the Secretary’s instructions are leading you to break the law. The rescan should not have begun without this testing having been done.”

Election Rules [8 CCR 1505-1] 
Tina Peters' case was Dismissed from the Denver District Court on September 6, 2022 for "lack of subject matter". Her case was filed in the Colorado Supreme Court on September 9, 2022 and Denied on September 12.

The El Paso Candidates case was filed in the CO Supreme Court on September 1, 2022 and the Justices declined to accept jurisdiction on September 2nd.

LOOK FOR UPDATED COURT DOCUMENTS HERE

The Appeal was filed in the Colorado Supreme Court on Wednesday evening.  Friday afternoon they received notice that the court declined to accept jurisdiction.
